WALDOPET APP END USER LICENSE AGREEMENT

Please read this End User License Agreement (“EULA”) carefully before using the WaldoPet App (“App”). This EULA is a legally binding agreement between you (referred to as “End User” or “you”) and WaldoPet (referred to as “Company,” “we,” “us,” or “our”). By installing, accessing, or using the App, you agree to be bound by the terms of this EULA.

1. LICENSE GRANT

1.1 Scope of License: Subject to the terms and conditions of this EULA, the Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial use on a mobile device or computer that you own or control.

1.2 Updates: The Company may from time to time provide updates or upgrades to the App. You acknowledge and agree that these updates or upgrades may be automatic and that you must install them to continue using the App.

2. USE OF THE APP

2.1 Restrictions: You agree not to: a. Modify, adapt, translate, or create derivative works of the App. b. Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App. c. Remove, alter, or obscure any copyright, trademark, or other proprietary notices in or on the App. d. Use the App for any illegal or unauthorized purpose. e. Use the App in a manner that could damage, disable, overburden, or impair the functionality of the App or interfere with any other party’s use of the App.

2.2 Ownership: The App is licensed, not sold, to you. The Company retains all right, title, and interest in and to the App, including all intellectual property rights. This EULA does not grant you any ownership or rights to the App.

3. PRIVACY

Your use of the App is also governed by our Privacy Policy, which can be found here. Please review the Privacy Policy to understand how we collect, use, and disclose information.

4. TERMINATION

This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from the Company if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the App and uninstall it from your devices.

5. DISCLAIMER

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

6. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF THE APP.

7. GOVERNING LAW

This EULA is governed by and construed in accordance with the laws of Wisconsin. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the state and federal courts located in Milwauikee.
